Contracts and disputes between UAE and Indian parties

In brief

The UAE appears on India's list of reciprocating territories (s.44A, civil procedure code): a money decree from one of its superior courts can be put into execution in an Indian district court, unless a statutory ground for refusal applies. Arbitral awards from New York Convention countries are enforceable in India, so DIAC, DIFC or ADGM arbitration is a common choice for cross-border contracts.

What is specific to UAE companies

The UAE is a reciprocating territory for certain courts; DIAC, DIFC and ADGM arbitration are common.

Anti-corruption and compliance programmes

Banks look through UAE companies to beneficial owners; NRI or resident-Indian ownership changes the FEMA analysis.

India's Prevention of Corruption Act includes corporate liability for persons acting on the company's behalf.
