In brief

France is not on India's reciprocating-territory list, so its court decrees cannot be executed in India as they stand; the winning party has to sue again in India on the foreign judgment. Arbitral awards from New York Convention countries are enforceable in India, so ICC arbitration seated in Paris is a common choice for cross-border contracts.

What is specific to French companies

French judgments need a fresh suit in India; ICC awards seated in Paris are enforceable. Sapin II requires anti-corruption programmes that reach Indian subsidiaries.

Anti-corruption and compliance programmes

Sapin II requires larger French groups to run an anti-corruption programme reaching subsidiaries, and the largest owe a duty of vigilance over their supply chains.

India's Prevention of Corruption Act includes corporate liability for persons acting on the company's behalf.
